The Federal Tax Service issued. In accordance with the new rules, the procedure for obtaining an enhanced unqualified electronic signature by taxpayers-individuals is simplified. Since both individual entrepreneurs and ordinary citizens will be able to receive such a signature completely free of charge in their personal taxpayer account on the official website of the Federal Tax Service. The need to approve the procedure for the formation of an enhanced unqualified electronic signature of a taxpayer arose in connection with the increased electronic document flow between tax authorities and taxpayers-individuals. After all, the role and functions of the taxpayer's personal account are now spelled out in the Tax Code of the Russian Federation. The corresponding one was introduced by the Federal Law of November 4, 2014 N 347-FZ. Since its entry into force, it has become mandatory for individuals to use the taxpayer's personal account not only to obtain information from the Federal Tax Service, but also to exchange documents with tax authorities. In particular, taxpayers can use the personal account resource to send tax returns. However, the use of an enhanced unqualified electronic signature is mandatory. After all, only documents certified by her are considered equivalent to documents on paper, certified by the taxpayer's handwritten signature. To obtain an electronic signature, the taxpayer must fill out a special form and attach all the necessary documents to it. After that, the taxpayer receives a certificate of the electronic signature verification key. This certificate is valid for 12 months from the date of issue. Verification of the electronic signature of the taxpayer and control over certificates in the personal account is carried out by the Interregional Inspectorate of the Federal Tax Service of Russia for Centralized Data Processing. If the taxpayer has lost the key certificate of his electronic signature or suspects that third parties have gained access to it, he must file an application for key cancellation. Such a written application is sent to the Interregional Inspectorate of the Federal Tax Service of Russia for Centralized Data Processing through the taxpayer's personal account. After that, the certificate is canceled and the taxpayer gets the opportunity to request a new electronic signature key. All these operations are carried out by the Federal Tax Service absolutely free of charge within one working day. At the same time, the Federal Tax Service is obliged to notify the taxpayer of the need to issue a new certificate of the electronic signature verification key, if it expires, no later than 14 days before the specified date. Thus, the taxpayer no longer has to independently monitor the expiration date of his electronic signature key. The Order of the Federal Tax Service was officially published on September 24, 2015 and comes into force on October 5, 2015. Until that time, there is a test procedure for issuing electronic signatures for individuals in the taxpayer's personal account. All key certificates issued in this way will continue to be valid until the expiration date for which they were originally issued. This will relieve taxpayers of the need to once again deal with the design and confirmation of their signature.

An electronic signature (ES) is information in electronic digital form that can be used to identify an individual or legal entity without his personal presence.

There are two types of electronic signature used in electronic document management:

  • simple electronic signature;
  • enhanced electronic signature (can be qualified and unqualified).

They differ in the degree of protection and scope.

2. What is a simple electronic signature?

A simple electronic signature is, in fact, a combination of login and password, confirmation code by email, SMS, USSD and the like.

Any document signed in this way is not, by default, equivalent to a paper document signed by one's own hand. This is a kind of statement of intent, which means that the party agrees to the terms of the transaction, but does not participate in it.

But if the parties conclude an agreement on the recognition of an electronic signature as an analogue of a handwritten one at a personal meeting, then such documents may acquire legal significance. So, for example, it happens when you connect an online bank to a credit or debit card. A bank employee identifies you by your passport, and you sign an agreement to connect an online bank. In the future, you use a simple electronic signature, but it has the same legal force as a handwritten one.

3. What is an enhanced unqualified electronic signature?

An enhanced unqualified electronic signature is two unique sequences of characters that are uniquely related to each other: an electronic signature key and an electronic signature verification key. To form this bundle, cryptographic information protection tools are used ( Cryptographic information protection tools (CIPF) are tools that allow you to sign digital documents with an electronic signature, as well as encrypt the data contained in them, thereby contributing to their reliable protection from third-party interference. CIPF are implemented in the form of software products and technical solutions.

By itself, an enhanced unqualified signature is not an analogue of a handwritten signature. It means that the document was signed by a specific person and has not changed since then. But such a signature is usually valid only in conjunction with an agreement on recognizing it as handwritten. True, not everywhere, but only in the document flow with the department (organization) with which such an agreement was signed.

4. What is an enhanced qualified electronic signature?

An enhanced qualified electronic signature differs from an enhanced unqualified one in that cryptographic information protection tools (CIPF) certified by the Federal Security Service of the Russian Federation are used to form it. And only a certification center accredited by the Ministry of Digital Development, Communications and Mass Media of the Russian Federation can issue such a signature. In this case, the qualified certificate of the electronic signature verification key, which is provided by such a center, becomes the guarantor of authenticity. The certificate is issued on a USB stick. In some cases, you may need to install additional software to use it.

An enhanced qualified signature is an analogue of a handwritten signature. It can be used everywhere, but for use in working with a number of organizations, additional information must be entered into a qualified electronic signature certificate.

How to get an enhanced qualified electronic signature

To obtain an enhanced qualified electronic signature, you will need:

  • identity document;
  • insurance certificate of compulsory pension insurance (SNILS);
  • individual taxpayer number (TIN);
  • the main state registration number of the entry on the state registration of an individual as an individual entrepreneur (if you are an individual entrepreneur);
  • an additional set of documents confirming your authority to act on behalf of the legal entity (if you receive the signature of a representative of the legal entity).

Documents must be submitted to an accredited certification center (you can find them in the list or on the map) or to the business services center in the Eastern Administrative District at the address: Moscow, Srednyaya Pervomaiskaya street, 3. An employee of the center, after establishing your identity and checking the documents , writes the certificate and electronic signature keys to a certified electronic medium - an electronic card or a flash drive. The cost of the service for providing a certificate and keys of an electronic signature is determined by the regulations of an accredited certification center and depends, in particular, on the scope of the electronic signature.

5. Does an e-signature have an expiration date?

The validity period of the certificate of the electronic signature verification key (both qualified and unqualified) depends on the cryptographic information protection tool (CIPF) used and the certification center where the certificate was received.

Typically, the validity period is one year.

The signed documents are valid even after the expiration of the certificate of the electronic signature verification key.

6. What is ESIA and why is it needed?

The Federal State Information System "Unified Identification and Authorization System" (ESIA) is a system that allows citizens to interact with authorities online.

Its advantage lies in the fact that a user who has registered in the system once (on the gosuslugi.ru portal) does not need to go through the registration procedure on state and other resources each time to gain access to any information or service. Also, to use resources that interact with the ESIA, you do not need to additionally identify your personality and equate a simple electronic signature with a handwritten one - this has already been done.

With the development of e-government and electronic document management in general, the number of resources interacting with the ESIA is growing. So, private organizations can already use the ESIA.

Since 2018, a system for remote identification of clients of Russian banks and users of information systems began to operate, subject to registration with the ESIA and the provision by a citizen of his biometric data (face image and voice sample) into a single biometric system. That is, banking services can be received without leaving home.

There are several account levels on the gosuslugi.ru portal. Using the simplified and standard levels, you sign applications with a simple electronic signature. But in order to access all services, you need a verified account - for this you need to verify your identity, that is, equate a simple electronic signature with a handwritten one.

On the website of the Federal Tax Service

Individuals, receiving services through a personal account on the website of the Federal Tax Service, use an enhanced unqualified signature, equivalent to a handwritten one. The verification key certificate can be obtained in the personal account itself, but personal identification and equating the electronic signature with a handwritten one occur at the level of entering the personal account: you can enter either using the login and password that are issued during a personal visit to the tax office, or using a verified account records on the gosuslugi.ru portal, or even with an enhanced qualified electronic signature.

But individual entrepreneurs and legal entities may need an enhanced qualified signature to receive services (for example, to register an online cash register).

On the website of Rosreestr

Part of Rosreestr's services (for example, apply, make an appointment) can be obtained using a simple electronic signature. But most services are provided to those who have an enhanced qualified electronic signature.

To participate in electronic trading

In order to participate in electronic trading, an enhanced qualified electronic signature is required.

An electronic digital signature (EDS) is a direct consequence of technological progress, which is becoming more and more tangible in the life of the Russian taxpayer. Electronic document management is introduced everywhere in the country. In order to assure them, just need an EDS. An electronic signature saves time when processing documents. In fact, this is a technological analogue of the usual and familiar “autograph”. There is nothing particularly complicated here, and everything can be done on your own, without anyone's help. Generally speaking, to obtain a digital signature of an IP, you will need to perform the following steps:

  • select the type of digital signature and certification authority;
  • fill out an application;
  • pay the bill and submit confirmation;
  • submit relevant documents.

If everything is done correctly, come and get your electronic signature. To do this, you will need to contact any certification center and provide the originals of the required documents.

Now let's look at the process described above in a little more detail. So, the first thing to decide is the type of electronic signature, that is, to think for what tasks and purposes you will need it. This can be, for example, a key for reporting to the Federal Tax Service, the Pension Fund, Rosfinmonitoring, and so on, working with EPGU, EGAIS, or giving the right to participate in bidding and auctions. EDS is divided into:

  • simple;
  • unskilled;
  • qualified.

Next, we determine the certification center, which will be engaged in the production and issuance of your electronic signature. Their list can be found by going to the official website of the Ministry of Communications and Mass Media of the Russian Federation. Everything is very simple here. Once on the main page, find in the "Important" column the "Accreditation of certification centers" section. After clicking on it, a window with the current list of CAs will open in front of you. It can be studied on the monitor screen or downloaded as an xls file that can be opened using any spreadsheet editor.

The next step is filling out an application for issuing an electronic signature. There are two possible options here - personally coming to the office of the certification center or remotely, via the Internet. It is clear that the second option is more convenient. Here, too, there should be no difficulty.

As a rule, CAs place forms for ordering digital signatures on their websites. You, in turn, will need to provide your own data, including your email address and contact phone number. You should also leave a comment in the appropriate column, indicating why you need an EDS. In some cases, you will need to enter a captcha. After that, you can click on the "Submit Application" button. In most cases, managers contact applicants very quickly. In the course of communication, some details are clarified, and detailed advice is provided on all relevant issues.

After that, you need to pay the bill. An electronic signature is not issued free of charge. To get it, you have to go to certain expenses. The exact amount here depends on a number of factors. In particular, the type of electronic signature matters, as well as the scope of its further application. An important role is played by the prices determined by the certification center itself. In other words, you can try to look for where it is cheaper, since the pricing policy of the CA is different. Another important factor is the region in which the electronic signature is issued.

Generally speaking, the cost of an EDS consists of the costs of:

  • issuance of a key certificate and its issuance;
  • granting the right to work with specialized software;
  • issuance of software necessary for operation;
  • technical support.

There is one more factor to add to this. We are talking about the costs of transferring the key of the EDS carrier. You can give average figures - obtaining an electronic signature today costs from 5 to 20 thousand rubles.

After the payment is made, we proceed to the penultimate stage - the submission of documents. Individual entrepreneurs who want to receive an electronic signature will need to submit to the CA:

  • relevant statement;
  • copies of passport pages with a photo and place of registration;
  • SNILS;
  • extract from the USRIP - a notarized copy, or the original;
  • IP state registration certificate.

Only one clarification needs to be made here. An extract from ENRIP must be up-to-date - no more than 6 months must pass from the moment it is received. However, some certification authorities may have their own requirements for this item.

An individual entrepreneur is obliged to report to regulatory authorities along with legal entities. The volume of reporting duties, of course, is somewhat different, often less than that of companies, however, it is much more pleasant and efficient to perform them without tedious visits to inspections and funds, but using the method of remote data transfer. The advantages of electronic document management are obvious. But to use them, you need a special electronic signature. How to get an electronic signature for an individual entrepreneur and how does an electronic signature for an individual entrepreneur differ from the electronic signature of legal entities and the usual electronic signature of an individual? Electronic digital signatures are used for individuals, individual entrepreneurs and companies, that is, the choice of a specific option does not depend on who exactly draws up the signature, but is related to what the EDS will be used for. For individuals, it is perhaps not so important to have the most reliable enhanced qualified signature, they may well get by with an unqualified one, including when interacting with the Federal Tax Service.

Where to get an electronic signature for individuals

You can get an electronic signature for an individual in the taxpayer's personal account on the website of the Federal Tax Service. We are talking specifically about the EDS for individuals, that is, such a signature is suitable for solving only those issues that do not relate to the activities of its owner in the form of an individual entrepreneur or head of a company.

To issue such a signature, an individual needs, first of all, access to the taxpayer's personal account, and he, in turn, will connect through the login - the citizen's TIN, and a special password issued when visiting the IFTS. Both on the website of the Federal Tax Service itself and in many open sources, information is provided in detail on how to obtain an EDS for an individual in the taxpayer's office. At the same time, you can solve the issue of how to make an electronic signature, if we are talking about an unqualified ES, by yourself by creating a program code for a certificate using special software. This is another difference between an unqualified signature and a qualified one.

How to get an EDS for individual entrepreneurs and legal entities

If an electronic signature for individuals that allows interaction with the IFTS may be unqualified, then an EDS for individual entrepreneurs and companies serving for the same purposes must be qualified, that is, issued by a special certification center with appropriate accreditation. It is impossible to release the CEP on its own. It is with the help of such an electronic signature that individual entrepreneurs and firms are required to certify the reports they submit to the Federal Tax Service and funds. A qualified signature is also useful for many other actions, within which electronic document management is legally valid without additional agreements, including for working with state information systems, for example, an EDS for Rosreestr. An individual is the owner of such a signature, however, there is always a link: either the documents are signed by an individual entrepreneur, or a representative of a company - a director or other person authorized for certain actions.

The registration of an electronic signature is carried out by a special certification center on the basis of an application from an individual entrepreneur or the head of a legal entity. Such a statement indicates the main details of the company or individual entrepreneur, as well as the TIN, SNILS and passport data of the representative - this is an individual for whom an electronic signature is being issued.

After submitting an application, and this usually happens in electronic form, the certification center considers the application, the future owner of the certificate is invited to the office directly to verify his identity. And here it is necessary to take into account an important point. The certification center can independently request information about the registration of an LLC or individual entrepreneur in the unified state register. Simply put, it is usually not required to confirm the registration of a company by providing certificates or constituent documents. But the passport data of an individual is protected by the law on personal data. The certification center will not be able to verify them without providing the original or a notarized copy of the passport. Actually, this requires a personal visit of the future owner of the electronic signature, who, in addition to the passport, must also provide the original TIN and SNILS. This is a general rule for all certification centers that issue enhanced qualified electronic signatures. However, of course, each of them may have its own slightly different specifics of interaction with customers.

Another moment that unites all accredited centers is the issuance of EDS exclusively on a paid basis. At the moment, there are no opportunities to issue a qualified electronic signature for individual entrepreneurs and legal entities for free in Russia.
